The Department of State to the German Embassy

Memorandum

The Department of State has the honor to refer to the German Embassy’s communication of November 18, 1933, as well as to the conversation of February 8, 1934, between the German Ambassador and the Secretary of State regarding the use of scrip to promote German exports and the question of whether this procedure affords grounds for applying to such exports the provisions of Section 303 of the United States Tariff Act of 1930 and Section 201 of the United States Anti-Dumping Act of 1921.

While, as orally stated yesterday, it is not practicable for the Department of State to accede to the Ambassador’s request for assurances [Page 406] at this time that the provisions of the two Acts mentioned will not in the future be invoked, it may nevertheless be stated that the observations on this subject embodied in the Embassy’s note of November 18th last were brought to the attention of the various interested agencies of this Government, and furthermore, that they are cognizant of the desire, which was expressed orally to Mr. Phillips92 by the Ambassador on November 23 last, to be allowed an opportunity of explaining the entire situation before any decision is reached.

The Embassy’s continued interest in this question is being brought to the attention of the interested agencies of this Government for their information.
