E. T. Ezekiel, being first duly sworn, deposes and says: That he is a resident of the city and county of San Francisco, State of California; that he makes frequent trips in sailing vessels to Alaska, and is acquainted with the general build and speed capacity of most of the sailing vessels which leave this harbor for the Alaskan [Page 208] coast; that he is particularly posted concerning the sailing vessels which for years comprised the fleet engaged in sealing in the Bering Sea, and also off the Japan coast; that he was familiar with the schooner James Hamilton Lewis prior to the seizure of the said vessel by the Russian war vessel Aleut on the 2d day of August, 1891; that he knows of his own knowledge that said vessel was in no way different from the ordinary craft belonging to the sailing fleet, and that the average speed of vessels of her class ranges between 5 and 9 knots per hour, but rarely reaches the latter limit.
