400. Referring to my telegram number 397 of October 6, 6 p.m.,²⁰ Supreme Court decided on October 8²¹ not to take action on question of constitutionality of decree of March 18 and expropriation law of 1936. Basis of decision was that executive power had not as yet resolved the appeal entered with administrative authorities by the companies against the expropriation action. See third paragraph my telegram number 390 of September 29, 1938.²² Air mail despatch follows.
